CHILD PARTICIPATION AGREEMENT, RISK WARNING & PARENT/GUARDIAN WAIVER

1. Parent/Guardian Authority, Participation & Risk Warning
I am the parent or legal guardian of the child identified in this agreement ("Child"), and I have authority to give the consents and acknowledgements contained in this agreement in relation to the Child. I request and consent to the Child participating in Brazilian Jiu Jitsu ("BJJ"), grappling, martial arts training, fitness activities, classes, open mats, seminars, gradings, competitions, demonstrations and other related activities provided or organised by RISEN Jiu Jitsu Pty Ltd trading as RISEN Jiu Jitsu ("RISEN"). Training may include conditioning, drilling, positional training, sparring or "rolling", takedowns, throws, sweeps, pins, joint locks, chokes and other techniques involving direct physical contact. Risk Warning: BJJ and martial arts are physical contact sports and recreational activities involving inherent and significant risks of physical injury. Risks include, without limitation, falls, collisions, strains, sprains, bruising, cuts, joint or ligament injuries, dislocations,
fractures, head or facial injuries, concussion, choking or submission-related injury, aggravation of pre-existing conditions, skin or communicable infections, and injury associated with strenuous exercise, mats, training equipment, facilities or physical contact with instructors or other participants. Serious injury, permanent disability and, in rare circumstances, death may occur. I understand that not every risk can be anticipated or eliminated. Having considered this risk warning, I voluntarily consent to the Child participating with knowledge of these risks and accept the inherent and obvious risks associated with BJJ and martial arts training.
2. Child Health, Fitness & Hygiene
I confirm that, to the best of my knowledge, the Child is physically capable of participating. I agree to disclose to RISEN any injury, illness, medical condition, allergy, physical limitation or medication that may reasonably affect the Child's ability to participate safely, and to update RISEN if relevant circumstances change. I agree that the Child will not attend or participate while the Child has, or I reasonably suspect the Child has, a contagious illness, skin infection or other condition that may create a health risk for other participants. I understand that RISEN may reasonably restrict the Child's participation where necessary for health, hygiene or safety. I understand that RISEN instructors and staff are not medical practitioners. If I am uncertain about the Child's ability to participate safely, I will obtain appropriate medical advice before allowing the Child to train.
3. Safety, Behaviour & Instructions
I agree to ensure, so far as reasonably practicable, that the Child understands the importance of following reasonable instructions from RISEN instructors and staff, training in a controlled and respectful manner, releasing techniques immediately when a training partner taps or otherwise submits, communicating injuries or safety concerns, complying with RISEN rules and hygiene standards, and stopping participation when directed. I understand that RISEN may reasonably remove or restrict the Child from an activity where necessary for safety, behaviour, health or the proper conduct of a class.
4. First Aid & Emergency Treatment
If the Child is injured or becomes unwell, I authorise RISEN and its instructors or staff to provide or arrange reasonable first aid, contact me or the Child's nominated emergency contact, contact emergency services, and, where reasonably considered necessary, arrange ambulance transport or medical treatment. If I cannot be contacted promptly, I authorise RISEN to take reasonable steps in
the Child's interests without waiting for further consent. I understand that I remain responsible for resulting ambulance, hospital or medical costs, subject to any applicable insurance or legal entitlement.
5. Drop-Off, Pick-Up & Supervision
I remain responsible for the Child before the Child is accepted into a scheduled RISEN class or activity and after that class or activity has concluded. I agree to arrange safe and timely drop-off and collection and to ensure that a responsible parent, legal guardian or authorised adult is available to collect the Child when required. I understand that RISEN's supervision relates to the scheduled class or activity and does not constitute general childcare or supervision outside that period. If another person will collect the Child, I am responsible for ensuring that person is appropriately
authorised. I will inform RISEN of any relevant collection, custody or safety arrangement that RISEN reasonably needs to know.
6. Waiver, Release & Indemnity
To the maximum extent permitted by law, including section 5N of the Civil Liability Act 2002 (NSW) and section 139A of the Competition and Consumer Act 2010 (Cth), I acknowledge and agree that the Child's participation in the recreational services and activities provided by RISEN involves the risks described in this agreement and is undertaken with my informed consent. To the extent that I may lawfully do so in my own capacity as parent or legal guardian, I agree that any term, guarantee, warranty, right or remedy relating to the provision of RISEN recreational services may be excluded, restricted or modified in respect of personal injury or other loss or damage for which such exclusion, restriction or modification is legally permitted. To that extent, I release and discharge RISEN, its owners, directors, instructors, employees, contractors and agents from liability in relation to claims that I may personally bring arising from the Child's participation, and I agree to indemnify those persons against claims brought by me in my own capacity to the extent that such claims may lawfully be released or indemnified. Nothing in this agreement is intended to waive or compromise any right belonging to the Child that a parent or legal guardian cannot lawfully waive on the Child's behalf, or to exclude, restrict or modify any right, guarantee, remedy or liability that cannot lawfully be excluded, restricted or modified, including liability that cannot be excluded under section 139A of the Competition and Consumer Act 2010 (Cth).
7. Photography, Video & Media Consent
I consent, as the Child's parent or legal guardian, to RISEN photographing, filming or otherwise recording the Child during classes, training sessions, seminars, competitions, events and other RISEN activities. I authorise RISEN to capture, use, reproduce, edit and publish photographs, video recordings and other media in which the Child may appear for purposes connected with the operation and promotion of RISEN, including its website, social media, digital advertising, promotional materials, educational or training content and marketing communications.
I understand that such media may be published publicly and may remain in circulation after publication. I acknowledge that neither I nor the Child is entitled to payment, royalties or other compensation for authorised use of such media. RISEN will use such media reasonably and respectfully and will not knowingly use the Child's image in a misleading, defamatory or inappropriate manner.
8. Continuing Agreement & Parent/Guardian Acknowledgement
This agreement applies to the Child's free trial and, unless replaced or otherwise ended in accordance with applicable law, to the Child's subsequent participation in RISEN activities.
By signing, I confirm that I am the Child's parent or legal guardian and have authority to provide the consents in this agreement; I have read and understood this agreement and the risk warning above; I understand that BJJ involves significant physical contact and risk of injury; I have had the opportunity to ask questions; the information I provide to RISEN concerning the Child is accurate to the best of my knowledge; I voluntarily consent to the Child's participation; and I agree to these terms in my capacity as the Child's parent or legal guardian.
